Terms and Conditions

1. Acceptance of Terms

By creating an account, accessing, or using the Dech platform at dech.in ("Platform"), you ("User", "you", "Business Owner") agree to these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree, you must not use the Platform.

These Terms constitute a legally binding agreement between you and Dech ("we", "us", "our"), operated under Indian law.

2. Description of Service

Dech is a chat-first lead capture and CRM platform that enables small businesses to:

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

• Build structured forms to collect customer inquiries.
• Share forms via WhatsApp Web links and Instagram DM flows.
• Store, organize, and manage customer leads in a dashboard.
• Track lead status, follow-ups, revenue, and customer details.
• Receive email notifications on new form submissions (Pro plan).
• Send automated WhatsApp messages via Meta Cloud API (Enterprise plan).

3. Eligibility and Account Registration

You must be at least 18 years of age to use Dech. By registering, you confirm that:

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

• All information you provide is accurate and current.
• You are using the Platform for lawful business purposes.
• You are responsible for maintaining the confidentiality of your account credentials.
• You will notify us immediately at support@dech.in of any unauthorized account access.

4. Plans, Pricing and Payments

4.1 Free Plan

The Free plan includes 1 form and 50 responses per month at no charge. No credit card is required.

4.2 Paid Plans

Pro and Enterprise plans are available at the pricing listed on dech.in/pricing. Prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.

4.3 Payment Processing

All payments are processed via Razorpay. By making a payment, you agree to Razorpay's terms of service. Dech does not store your card or bank details.

4.4 Plan Activation

Paid plans are activated immediately upon successful payment confirmation. You will receive an invoice via email for every successful transaction.

4.5 Refunds

Due to the digital nature of the service, refunds are generally not provided after plan activation. If you believe you were charged in error, contact support@dech.in within 7 days of the transaction.

5. Acceptable Use

You agree not to use Dech to:

Violation of acceptable use policies may result in immediate account suspension without refund.

• Collect personal data without the informed consent of your customers.
• Send unsolicited messages, spam, or deceptive communications.
• Violate any applicable Indian law, regulation, or third-party rights.
• Impersonate another business, brand, or individual.
• Distribute malware, harmful code, or fraudulent content through forms.
• Attempt to reverse engineer, scrape, or exploit the Platform.
• Use the Platform for activities prohibited by WhatsApp's or Meta's terms of service.
• Collect sensitive personal data without appropriate legal safeguards and explicit consent.

6. Your Obligations as a Data Controller

When your customers fill your Dech forms, you are collecting their personal data. You are legally responsible for how that data is collected, used, and protected.

As a Business Owner using Dech to collect data from your customers, you are the Data Fiduciary / Data Controller under the Digital Personal Data Protection Act, 2023 (DPDP Act) and other applicable Indian laws.

6.1 Obtain Valid Consent

Obtain free, informed, specific, and unambiguous consent from your customers before collecting their personal data through Dech forms. You must clearly inform them of what data is being collected, the purpose for which it is being collected, how long it will be retained, and whether it will be shared with third parties.

6.2 Provide a Privacy Notice

Maintain and display a privacy notice or policy to your customers that describes how you use the data you collect through Dech forms. Dech's Privacy Policy covers Dech's data practices - it does not cover yours.

6.3 Honor Data Principal Rights

Respond to your customers' requests to access, correct, or delete their personal data that you have collected via Dech forms. Dech can assist with data deletion from the platform upon your request.

6.4 Prohibited Data Categories

You must not use Dech forms to collect the following types of data unless you have implemented appropriate legal safeguards, explicit consent, and security measures:

• Aadhaar numbers or government-issued ID numbers.
• Financial credentials, bank account numbers, or payment card details.
• Passwords or authentication credentials.
• Medical or health records.
• Biometric data.
• Data relating to minors under 18 years of age.

6.5 No Illegal Data Collection

You must not use Dech to collect data in violation of any applicable law, including the DPDP Act 2023, the IT Act 2000, or any sector-specific regulation.

7. Indemnification

You agree to indemnify, defend, and hold harmless Dech, its operators, employees, and service providers from and against any claims, liabilities, damages, losses, penalties, or expenses (including reasonable legal fees) arising out of or related to:

This indemnification obligation survives termination of your account.

• Your violation of these Terms.
• Your unlawful or unauthorized collection of your customers' personal data through Dech forms.
• Your failure to obtain valid consent from your customers.
• Any claim by your customers regarding how you have used or misused their personal data.
• Your breach of applicable data protection laws.

8. Intellectual Property

All content, branding, code, design, and features on the Dech Platform are the intellectual property of Dech. You retain ownership of all content you create within the Platform, including form content, brand assets, and customer data. By using the Platform, you grant Dech a limited, non-exclusive license to process and store your content solely to provide the service.

9. Third-Party Services

Dech integrates with the following third-party services:

We are not responsible for the availability, policies, or actions of these third-party providers. These services also process data on our behalf as sub-processors under our Data Processing Agreement.

• WhatsApp / Meta - message delivery, subject to Meta's terms of service.
• Google Firebase - data storage and authentication.
• Razorpay - payment processing.
• Gmail SMTP - email notifications.

10. Disclaimer of Warranties

The Dech Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding uninterrupted service, data accuracy, fitness for a particular purpose, or security against all unauthorized access.

11. Limitation of Liability

To the maximum extent permitted by law, Dech shall not be liable for any indirect, incidental, special, or consequential damages including loss of business, leads, revenue, or data. Our total liability for any claim shall not exceed the amount paid by you to Dech in the 3 months preceding the claim.

12. Termination

You may terminate your account at any time by contacting support@dech.in. Upon termination, your data will be retained for 30 days and then permanently deleted. We may suspend or terminate your account without notice for violations of these Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India. We encourage informal resolution via support@dech.in before pursuing legal action.

14. Changes to These Terms

We may update these Terms at any time. For material changes, we will notify you via email or a Platform notice at least 7 days before the changes take effect. Continued use constitutes acceptance of the revised Terms.
